Welcome to CertiTrust. These Terms of Service ("Terms") govern your use of our legal consultation services and website. By scheduling a consultation, using our services, or accessing our website, you agree to be bound by these Terms.
1. Services Overview
1.1 Legal Consultations
CertiTrust provides legal consultation services in the Dominican Republic, including:
- Online Group Consultations: Virtual sessions where participants can ask questions and receive general legal guidance (RD$1,000 per person, up to 20 minutes per participant)
- Personalized Consultations: Private sessions (online or in-person) providing detailed legal analysis and advice (RD$2,500 per person, 40-50 minutes)
1.2 Practice Areas
Our services cover Real Estate Law, Tax Law, Corporate Law, Criminal Law, Family Law, Civil Law, and Administrative Law.
2. Nature of Consultations
2.1 Guidance Only
Important: Consultations are for legal guidance purposes only. During a consultation, an attorney will analyze your situation, answer questions, and suggest possible courses of action. However, consultations do not constitute legal representation.
2.2 No Attorney-Client Relationship for Representation
Scheduling and attending a consultation does not automatically create an attorney-client relationship for the purpose of legal representation in proceedings or transactions. If you require formal representation after a consultation, a separate engagement agreement must be executed, outlining scope, fees, and terms.
2.3 Information Reliance
The advice provided during consultations is based on the information you share with us. The accuracy and completeness of your information directly affects the quality of guidance we can provide. You are responsible for providing truthful and complete information.
3. Scheduling and Booking
3.1 Booking Process
To schedule a consultation:
- Contact us via WhatsApp, email, or phone
- Select your consultation type (group or personalized)
- Choose an available date and time
- Complete payment
- Send proof of payment for verification
- Receive confirmation of your booking
3.2 Confirmation
Your consultation is not confirmed until we have verified your payment and sent you a confirmation. Please retain your confirmation details.
4. Payment Terms
4.1 Fees
Current consultation fees are:
- Online Group Consultation: RD$1,000 per person
- Personalized Consultation: RD$2,500 per person
Fees are subject to change. The fee applicable to your consultation is the one in effect at the time of booking.
4.2 Payment Methods
We accept payments through bank transfer and other methods communicated during the booking process. Payment must be received before the consultation takes place.
4.3 Taxes
All fees are quoted in Dominican Pesos (RD$). Applicable taxes, if any, are included in the stated price unless otherwise indicated.
5. Cancellations and Rescheduling
5.1 Cancellation by Client
- More than 48 hours before: Full refund or rescheduling at no additional cost
- 24-48 hours before: 50% refund or rescheduling with administrative fee
- Less than 24 hours before: No refund; rescheduling subject to availability and additional fee
5.2 No-Shows
If you fail to attend your scheduled consultation without prior notice, you forfeit your payment. No refunds or rescheduling will be offered for no-shows.
5.3 Cancellation by CertiTrust
If we must cancel your consultation due to unforeseen circumstances, we will offer you a full refund or the option to reschedule at no additional cost.
5.4 Rescheduling
Rescheduling requests must be made at least 24 hours before your scheduled consultation. We will do our best to accommodate your preferred new date and time.
6. Conduct During Consultations
6.1 Group Consultation Rules
During group consultations, participants must:
- Respect the allotted time per person (up to 20 minutes)
- Maintain professional and respectful communication
- Not share other participants' information outside the session
- Understand that general guidance is provided, not private legal advice
6.2 Recording Prohibition
Recording of consultations (audio or video) is prohibited without prior written consent from CertiTrust.
7. Confidentiality
Information shared during consultations is treated as confidential under attorney-client privilege, subject to the limitations described in our Privacy Policy and applicable law. We will not disclose your information without your consent, except as required by law.
8. Limitations of Liability
8.1 No Guarantee of Outcomes
CertiTrust does not guarantee any particular outcome from consultations or any subsequent legal matters. Legal outcomes depend on many factors beyond our control.
8.2 Limitation of Damages
To the maximum extent permitted by law, CertiTrust's liability for any claim arising from our services shall not exceed the amount you paid for the consultation giving rise to the claim.
8.3 Exclusions
We are not liable for:
- Decisions you make based on consultation guidance
- Technical issues affecting online consultations
- Actions of third parties
- Indirect, consequential, or punitive damages
9. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of CertiTrust and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Website Use
10.1 Acceptable Use
You agree to use our website only for lawful purposes and in accordance with these Terms. You may not use our website in any way that could damage, disable, or impair our services.
10.2 Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content or practices of any linked sites.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Dominican Republic. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Santo Domingo, Dominican Republic.
12. Dispute Resolution
Before initiating any formal legal action, you agree to contact us to attempt to resolve any dispute informally. We will make good faith efforts to resolve any issues through direct communication.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any specific engagement agreements, constitute the entire agreement between you and CertiTrust regarding the use of our services.
